Purpose

The adaptive governance assessment evaluates any governance structure — law, regulation, treaty, industry standard, or institutional charter — against the criteria of adaptive governance developed in the parent article. It determines whether the structure has the capacity to detect its own errors and correct them, or whether it operates on authority alone.

The Four Questions

Can rules be revised?

Evaluate against these indicators:

  • Does the governance structure include a defined revision mechanism (periodic review, amendment pathway, sunset clause)?
  • Are the revision criteria evidence-based and set at the time of creation, not retroactively?
  • Has the governance structure actually been revised in the last two cycles? If not, is there evidence that it has been evaluated and confirmed rather than simply neglected?

Red flag: The governance structure has no defined revision mechanism, or the mechanism requires conditions (unanimity, supermajority of beneficiaries) that make revision practically impossible.

Is dissent structurally safe?

Evaluate against these indicators:

  • Do affected parties have access to dissent channels independent of the governance body?
  • Are those channels protected against retaliation (formal and informal)?
  • Is dissent documented in the governance body's published rationale — meaning the body acknowledges the dissent and responds to it, whether or not it changes course?

Red flag: No dissent has been recorded in the last two cycles — or dissent is recorded but never referenced in the governance body's reasoning.

Are decisions evidence-based and publicly reasoned?

Evaluate against these indicators:

  • Does the governance body publish the evidence considered, the alternatives rejected, and the reasoning for its decisions?
  • Can affected parties access this documentation in a timely manner (before the decision takes irreversible effect)?
  • Is the published reasoning substantive — connecting evidence to conclusions — or pro forma?

Red flag: The governance body publishes decisions without reasoning, or publishes reasoning that does not reference specific evidence.

Do affected parties have voice and exit?

Evaluate against these indicators:

  • Can affected parties participate in the deliberative process through structured channels (formal comment, public hearing, stakeholder consultation)?
  • Has the deliberative process changed any significant decision in the last cycle?
  • Can affected parties exit the governance arrangement without penalty disproportionate to the benefits they received?
  • Are exit terms published at the time of entry?

Red flag: Exit terms are undefined, unpublished, or include penalties (data loss, contractual penalties, reputational sanctions) disproportionate to the arrangement's benefits.

How to Use the Results

The assessment produces a four-dimension profile. Each dimension is rated:

  • Adaptive: The indicators are met and the governance structure demonstrates active self-correction capacity.
  • Rigid: Some indicators are met but no evidence of actual revision exists — the mechanisms are present but unused.
  • Closed: Multiple indicators are unmet and the governance structure shows no capacity or willingness to self-correct.

A governance structure that is "closed" on dissent or exit should be treated as structurally authoritarian regardless of its formal design — because without safe dissent and meaningful exit, the structure cannot be corrected by the people it governs.

The assessment is designed to be run periodically — annually or at each governance review cycle — to track whether the structure's adaptive capacity is improving, stable, or degrading over time.
